Terms & Conditions

By making a purchase from Gemma Weighill Artist, through the online shop,  invoicing, bank transfer or any other type of payment you are agreeing to the terms and conditions outlined here.

Photographs

It is down to the client to provide photos of a true likeness/colour/expression of the subject(s) in order for optimum results.

If the individual would like a professionally taken photo to be used as reference, a letter of consent from the photographer MUST be obtained and forwarded on to myself with the photographs. They are artists too, please respect this.

Commissions may be turned down by myself, the artist, if I feel it is inappropriate to carry out a specific commission or if I feel I cannot meet the expectations of the commission.

 

Payment Terms

 All deposits are non- refundable. All commission orders over £50 require a 25% non-refundable deposit upon placing an order. NO booking will be secured until this has been received. The balance of payment will be due upon completion and must be paid within 10 days unless a prior arrangement has been made, If payment has not been received within 10 days your order will be cancelled and it will be offered for sale to the general public to recover some of the costs incurred,  Payments can be made by cheque (UK ONLY), direct bank transfer or by PayPal. 

A payment plan option is available on orders exceeding £125.00 = a non refundable deposit of 25% to be paid on booking and the remaining amount can be split into  smaller monthly instalments. Items will not be sent out until the balance has been received by Gemma Weighill. If paying by cheque, goods will be sent out after full payment has cleared the bank. All portrait orders below £50 must be paid for upfront. 

Any orders placed where there is no follow up or contact from the customer of any kind will after 12 months be considered void. Any money paid will become property of Gemma Weighill. All goods remain property of Gemma Weighill until the contract price in full is received. 

Gemma Weighill Artist's online shop - All orders placed via the online shop are dispatched within 7 working days unless stated otherwise.

Artworks

All copyright and reproduction rights are reserved by the artist of any artwork.  By commissioning from me you give me the right to use your photo(s) to reproduce artwork from. You also give me the right to display this artwork in any form, for example - social media. If you wish for me not to to put your commissioned artwork on social media and/or my website you must request this prior to booking in,  If you are happy for me to share it online after a certain date such as a Birthday then please let me know and I will happily oblige.

Delivery

All UK orders are shipped via Parcelforce or Royal Mail on a fully insured service. UK shipping is free for all portrait orders , international shipping starts from £10.  Guaranteed Next day delivery service is available upon request but however is subject to additional charges.  Gemma Weighill Artist's online shops shipping fee starts from £5.00.​ International orders are sent via  courier on an International track and trace service -

please get in touch for a shipping quote as it varies. Please note at this time due to the new GPSR rules I am unable to ship to EU countries. I am hopeful this will change in the near future.

Generic notice for customers outside the UK:
International customers are responsible for all fees associated with shipping to their respective countries. Orders shipped to countries outside of the UK may be subjected to import taxes, customs duties and fees levied by the destination country. The recipient of an international shipment may be subject to such import taxes, customs duties and fees, which are levied once a shipment reaches your country. Additional charges for customs clearance must be borne by the recipient; I have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country; you should contact your local customs office for further information. When customs clearance procedures are required it can cause delays beyond the original delivery estimates.

 

Shipping materials are reused when possible to help save the environment.

Missing or Damaged items, Refunds & Returns

All orders are packed very safely to ensure no damage occurs in transit, but sometimes accidents do happen. Customers should check their goods immediately on delivery and inform me of any damage suffered.  Any problems must be reported to myself within 14 days. The best and quickest way to do this is by email, phone or Facebook Messenger. Please ensure that you send photos of the damage. Once the photos have been received and inspected - all options will be discussed. 

If an item is damaged under the Consumer Rights Act 2015 you are entitled to a refund, replacement or repair.  If you (the customer) would like a full refund for damaged goods -  the damaged goods must be returned to myself within 14 days of receipt unused and in its original packaging. If the item is faulty the returning shipping cost will be reimburse however a proof of postage receipt must be obtained and a photo forwarded to myself.

The customer will be refunded within 14 days of the returned goods being received. If you would prefer a replacement this will be done as soon as possible and sent via a fully insured priority shipping service at no extra cost.

I cannot accept any responsibility or compensate for failed or late delivery. Any items that do not arrive on the estimated delivery dates should be reported within 24 hours of non delivery.  If the item is returned to myself for any reason the postage will be recharged for any subsequent delivery charges. It is the clients responsibility to ensure that a full and  correct delivery address is supplied. When your items are shipped you will be notified. 

Copyright

All copyrights of any artwork remain in the name of Gemma Weighill, unless otherwise mutually agreed in writing at the time of ordering. It is explicitly forbidden to reproduce the images and original artwork of Gemma Weighill in anyway and in any medium unless clearly agreed beforehand with a standard license contract available on request. This license can be revoked at any time due to breach of contract at the discretion of Gemma Weighill. 

Any authorized reproductions must contain credit to Gemma Weighill or artists website. Where digital images are involved the client agrees that the digital images cannot  be modified without prior consent and must contain credit to Gemma Weighill.

Cancellations and Refunds

If the customer wishes to cancel their order, then notice must be given in writing. Order deposits are non refundable.  If you have paid a deposit and either wish to cancel your commission, or do not wish to receive the artwork  (whether it be completed or not) you are not entitled to a partial or full refund.  In the event that you decide not to buy the artwork it will be offered for sale to the general public to recover some of the costs incurred,  For custom orders where the balance has been paid in advance, depending on how much work has been undertaken it will be up to myself to decide whether any refund is to be paid to the customer.  If in the unlikely event I cannot fulfil your commission you are entitled to a full refund.

 

 If the customer wises to cancel their order that was placed via the online shop, their notice must be given in writing. The order will be cancelled upon request UNLESS the item(s) have already been shipped.
